At fault driver insurance won't cover everything, who do I sue? (CA)?

I got rear ended by someone about a month ago. He did not have a driver's license, the only thing he had at the time was his ID issued by Mexico. The car he was driving was insured under Infinity and he was not the owner of the vehicle. A few days ago, Infinity sent someone to estimate the repair costs and it was determined to be around $2400. However, since my muffler/pipe was too old, they refused to cover everything and told me that I have to pay around $800 out of pocket. I took my car to the car shop yesterday, and the car shop estimated that the repair costs is actually going to be over $3000 and they've never heard of a company claiming that they're not covering the repair fees of certain component of a car simply because it's too old. My question is, in this situation, is the insurance company trying to scam me? If yes, should I sue? And if I do, do I sue 1)the driver, 2)the driver and the owner of the car, or 3) the driver, the owner of the car, and the insurance? And what would be my chance of winning?

Okay I was involved in a hit an run accident a little over 2 weeks ago. I have full coverage insurance including uninsured and underinsured coverage. Also the required 10,000$ personal injury protection required by my state KY. My policy is with AAA. HI All, my relative incidentally hint the few new motors in in a motor shop which selling new motor. The standing motors fall down each and another.
